The Board of Lincoln County Commissioners met at 9:00 a.m. on April 7, 2008.  The following attended:  Chairman Ted Lyons, Commissioners Steve Burgess and Gary Beedy, County Administrator Roxie Devers, and Clerk to the Board Corinne M. Lengel.  County Attorney Stan Kimble was present in the afternoon.

 

Chairman Lyons called the meeting to order and led the Pledge of Allegiance, and then Public Health Director Tonda Scott met with the Board to present the Community Health Survey.  Ms. Scott said this was the version that was used in Kit Carson County, and that she had also translated it to Spanish for those consumers in the county.  She asked that each board member complete a survey, as well as Ms. Devers and Ms. Lengel, and that they return them to her.  She added that her intention was to meet with other community boards, as well as take the surveys to local businesses, and ask that they distribute them. Her suggestion was that the consumers then return the survey to where they had picked it up, and Ms. Scott would find a way to collect them.  She felt that even if they got back twenty percent of those handed out it would be beneficial.  Ms. Scott’s parting comment was that she loved the van that her department had been given when Social Services purchased their new ones.

 

The Board approved a few expense vouchers for March, and then Bev Newbanks with Social Services met with them to ask for their signature on the Grandparenting Grant.  She explained that Lincoln County is the facilitator for the four counties; Lincoln, Cheyenne, Elbert and Kit Carson, and that each of those counties got four separate $350.00 grants.  Mr. Beedy made a motion to approve the Grandparenting Grant, Mr. Burgess seconded the motion, and it carried unanimously.

 

The Board approved the remaining expense vouchers for the month of March.

The minutes from the meetings held on March 31, 2008, and April 1, 2008, were approved as submitted.

 

Mr. Beedy made a motion to cancel County General check #764 in the amount of $22,790.00, written on December 31, 2007 to 18th Judicial District Attorney Carol Chambers, since the check was never received.  Mr. Burgess seconded the motion, which carried unanimously.  Ms. Devers said that she imagined they would like to have the check replaced, but since it was written in the 2007 budget year, the 2008 budget would take an unexpected hit.

 

The Board reviewed the March Sheriff’s report, as well as the March Treasurer’s report, and the March report of revenues and expenditures from the Treasurer.

Mr. Lyons called for commissioner reports, and Mr. Beedy said he’d attended the department head meeting on April 1, and then went to Karval on April 2 to meet with David Seymour.  He reported that someone had kicked the window out of their dozer, so they had it fixed.  They also worked on the bill to be sent to the Division of Wildlife for reimbursement for the county’s portion of work done on the road into Karval Lake.  On April 4, Mr. Beedy attended CCI where he learned that they are re-organizing and changing Public Health requirements.  He didn’t feel that it would be much of a problem here, since Lincoln County has its own Public Health department, but there would definitely be some adjustments.  He commented that one of the positive changes was that there may be a possible increase in the base funding to smaller counties.  Mr. Beedy went on to say that he felt the issue with taxing wind farm development may have been resolved and it didn’t look like it would impact Lincoln County much at all.  Apparently, the bill referred more to larger entities such as Wal Mart that have a wind tower on their own property that provides power specifically for their facility.  In regard to property taxes, any production under two megawatts would be assessed by the Assessor using state guidelines, and anything over that would be valued in the manner in which it has always been done.  Those counties that originally granted machine and machine tool exemptions for sales tax to encourage development would be affected; however, since Lincoln County did not grant that exemption it wouldn’t affect us at all.  In counties where the choice was made to exempt sales tax on specific components, a vote of the people would be required in order to modify the exemption.

 

Mr. Beedy also said that there are three bills in legislation regarding the re-structuring of how severance tax is to be distributed, but admitted that he hadn’t checked to see how it may affect Lincoln County.  He added that CCI came out in opposition to the toll bills for I-70, that he received some information from the Federal Transportation Committee, and that CCI approved the same resolution that the county commissioners had at their meeting on March 6 supporting the governor’s transportation finance and implementation panel report and funding threshold recommendations.

 

Earlier this morning, Mr. Beedy reported that he attended the Economic Development board meeting, and explained that the commissioners would likely receive a request for an increase in the amount they plan to contribute to Economic Development this year.  Local monetary pledges have dropped off consistently in the past several years, and if they cannot convince the businesses to donate more, there is a strong possibility that the office will no longer be able to stay open full time.  Mr. Beedy felt that it would probably close sometime in August.  He thought that the Town of Limon would try to give more, but Mr. Beedy did not know how much, and when Mr. Burgess asked how much more Economic Development would request from the county, he was told that they would like to have a three-year commitment of $20,000.00 each year.

 

Mr. Lyons felt that they could possibly cut down on office hours and Ms. Devers asked if Patricia Vice would continue to work if that were to happen.  Mr. Beedy didn’t know for sure and did add that Economic Development was a key player in the aggregate that will soon be hauled on the railway through Genoa, as well as other development that has been seen in the county.  He went on to say that in several other counties around the state, Economic Development is over fifty-percent funding by their government entities.

 

Ms. Devers asked if they had looked at grant funding and Mr. Beedy said that they had, although, as with most grants, only a certain percentage of the funding can be used for administrative purposes, or they are only a one-time grant.

 

Mr. Lyons said he would like to see them meet with other businesses in the county to see if they could obtain more contributions that way and Mr. Burgess agreed.  With inflation at a rapid increase, he added that he didn’t feel it would be possible to give any more, when it was all the county could do to afford fuel.

 

Mr. Burgess gave his report, stating that he had attended the department head meeting on April 1 and the COG meeting on April 2.  Apparently, a group in Elizabeth wanted COG to start a bus business, but the request was denied.  On April 3, Mr. Burgess attended the Baby Bear Hugs meeting, saying that their intended fund-raiser this year is a fifty-fifty, which is the same type of money-raiser that some of the schools held during their sporting events this past year.  A person buys a raffle ticket for a certain amount, and then half of the collected proceeds go to the entity sponsoring the event, while the other half goes to whoever holds the winning ticket that is drawn. 

On April 4, Mr. Burgess spoke with Joe Kiely about a company storing pipe in Limon for a crude oil pipeline they are putting in from Stratton to somewhere in Oklahoma.  He said he spoke with Land Use Administrator Ken Morrison about permits, but Mr. Morrison did not believe they would need a development permit for such a storage facility.  Mr. Burgess said he also received a telephone call from LeRoy Johnson, whom he will need to meet with, and then this morning he stopped by the landfill to pick up the receipts on his way to the commissioner meeting.  He asked that the others do so if they happen to be going by on their way to Hugo, at least until someone is hired for the part-time position.  He added that Mick Jaques told him his critical time for submitting the receipts to the Treasurer’s office was the first of the month, due to the fact that billing is done on the Thirtieth.   Mr. Burgess also spoke with Delayne Tornowski this morning, but there were no prisoners available to help with trash at the landfill since none of them have been sentenced yet.

 

Mr. Lyons reported that he also attended the department head meeting on April 1, and that on the Third he checked on County Road 63 and County Road 2W.  He talked to Travis Miller about getting some rotomill for the damage on 2W on Thursday and Friday, and then also spoke with Chris Monks about it on Friday and told him to work out the details with Travis.  On Saturday, Mr. Lyons stopped by the landfill.  He also reported that there would be a Weed Board meeting on April 17, and that he spoke with Shawn Smith about the curved window above the front doors at the courthouse.  Shawn told him he was having problems finding anyone with a window that shape, and the Board determined that they may have to replace the area with stucco.

 

After a short discussion on equipping the annex building with panic buttons to tie into the current system at the jail, since the wireless buttons won’t work that far away from the courthouse, Mr. Lyons placed a phone call to Eastern Slope Telephone to ask what it would cost.  When he was finished with his call, he reported that there would be a premise charge of $40.00, a $10.00 service charge to each line to add a line, and a $10.00 per month charge per line, which would result in a $240.00 annual bill for the annex building.  Since no one knew who had put the existing buttons in the various offices to begin with, a call was placed to Sheriff Tom Nestor to ask him. 

 

While waiting for the Sheriff, Ms. Devers said that she had one person interested in cleaning portions of the courthouse should janitor Nova Waite need someone to replace her while she is out after her surgery.   She produced a request from Treasurer’s office employee LaRay Becker-Patton to perform light cleaning duties for the Treasurer’s, Assessor’s, Clerk’s, and the Administrator’s and Land Use offices.  Ms. Becker-Patton thought she could complete the cleaning in five hours a week, and would do so for approximately six-to-eight weeks for twelve dollars an hour.  Ms. Devers said that some other issues had arisen with Mrs. Waite, but that she should have more information for the Board in a couple of weeks.  Ms. Lengel also put in that one of her employees had offered to clean the whole courthouse, but since the Clerk’s office works a forty-hour week, that employee would have to be paid overtime.

 

Sheriff Tom Nestor and Undersheriff Gordon Nall arrived to discuss panic buttons at the annex, and Mr. Burgess asked who wired in the original buttons in the various offices.  A company called Beacon Communications hooked new lines into an existing box and Sheriff Nestor wasn’t sure they would charge to add those at the annex, but he assumed they would.  He added that the phone company could probably complete the work also if they would work with Zane Nestor, who is good with that type of thing.  Mr. Lyons said he would speak with Chuck Helgerson at Eastern Slope once the sheriff had contacted Beacon Communications, and Mr. Burgess asked that the sheriff let them know if he found out what it would cost.

 

Mr. Burgess brought up the fact that no inmates were available to help at the landfill, as well as the fact that the dumpsters were constantly full at the courthouse.  He asked if anyone knew if there was a charge to have the dumpster emptied more often, but Mr. Lyons felt that the town has a set pick-up schedule and may not deviate from it.

 

Sheriff Nestor said that he checked over a month ago regarding sentencing of prisoners, but a trend seems to have been set, since it seems that court cases are always getting continued.  When asked if the Board could do anything to help, the sheriff said that it was more of a game than anything; the inmates get close to their court date and then fire their attorney so that the process has to start all over again.

 

Once the sheriff and undersheriff were gone, Mr. Lyons called for old business.  Mr. Burgess said that it was his understanding that they were going to put the old patrol car that Social Services had given back out for bid, yet he’d gone by the shop and Chris Monks had the motor out of it and was working on fixing it up.  He felt there had been a lack of communication, and wasn’t sure where the error had been made.  Mr. Lyons said he should talk to Chris.

 

Mr. Burgess also said that he had contacted Verizon Wireless about his cell phone taxes going to Elbert County, and the current billing was now correct again.

 

At 1:15 p.m., a hearing was conducted on Use by Special Review Permit Application #07-10 by Cedar Point Wind, LLC for the Cedar Point Wind Power Project.  Kara Pittsford and Jim Borgel with RES/Holland and Hart, Land Use Administrator Ken Morrison and two gentlemen from Lamar were also present.   The hearing was tape-recorded, and the tape is on file in the County Clerk’s vault. 

 

Ms. Pittsford gave a brief update on the project, Mr. Morrison said that he had nothing to add that hadn’t already been presented, and there were no comments or concerns from any members of the public audience.

 

Mr. Burgess asked how big the turbines would be, and Ms. Pittsford replied that they would be anywhere from 1.5 to 2.3 megawatts, but the specific size had not yet been determined.  She added that they did have a contract for 1.5 megawatt turbines with GE, which are most commonly used in the U.S. 

 

Further discussion on turbines and the development agreement, and whether or not Cedar Point, LLC would maintain ownership or sell the project were discussed, and then Ms. Devers asked Mr. Kimble what the proper procedure would be for the county to accept the project.  Mr. Kimble said that the Board would need to adopt a resolution, and Mr. Borgel said he had one with him, if they were so inclined to use it.  Mr. Kimble looked it over and said it would be fine, so Mr. Beedy made a motion to adopt a resolution to approve the Cedar Point Wind Power Project.  Mr. Burgess seconded the motion which carried unanimously.

A RESOLUTION GRANTING THE APPROVAL OF A USE BY SPECIAL REVIEW AND DEVELOPMENT PERMIT FOR THE CONSTRUCTION, OPERATION, MAINTENANCE AND REPLACEMENT OF A WIND ENERGY GENERATING FACILITY TO INCLUDE WIND TURBINE GENERATORS, ANEMOMETER TOWERS, OVERHEAD AND BURIED CABLE, ROADS, RIGHTS-OF-WAY, AN ELECTRICAL SUBSTATION, TRANSMISSION LINES AND OTHER REQUIRED FACILITIES AND USES IN PORTIONS OF TOWNSHIPS 6, 7 AND 8 SOUTH, RANGE 56 WEST, AND TOWNSHIP 6 SOUTH, RANGE 55 WEST OF THE 6TH PRINCIPAL MERIDIAN IN LINCOLN COUNTY, COLORADO.

 

            WHEREAS, Cedar Point Wind, LLC ("Cedar Point") has applied for the approval of a Use By Special Review and Development Permit ("Project Approvals") to construct a wind energy generation facility in accordance with the Lincoln County Application for Use By Special Review Permit submitted by Cedar Point Wind, LLC, dated November 20, 2007, together with the Use By Special Review Site Plan dated November 29, 2007 (together, the "Application").  The property subject to the Project Approvals is described in the attached Exhibit A (the “Property”).

 

            WHEREAS, the property is currently zoned Agricultural under the Lincoln County Zoning Resolution; and

 

            WHEREAS, Section 2‑220 of the Lincoln County Zoning Resolution allows for the approval of a Use By Special Review and Development Permit within the Agricultural Zoning District in accordance with the provisions of Article 3 of the Lincoln County Zoning Resolution; and

            WHEREAS, Cedar Point has obtained the consent of the owners of the Property to the Application and the Project Approvals in the form of leases and/or easement agreements which authorize Cedar Point to construct the Wind Energy Generation Facility and to obtain the Project Approvals; and

 

            WHEREAS, due to the substantial investment to be made by Cedar Point, and the amount of detailed planning, engineering and related work that will be required to construct the Wind Energy Generation Facility, Cedar Point has requested that the duration of the Project Approvals be for a term in excess of one year, as permitted by Section 1‑210 of the Lincoln County Zoning Resolution; and

 

            WHEREAS, at a public hearing held on March 5, 2008, the Lincoln County Land Use Board approved the Use By Special Review and Development Permit; and

 

            WHEREAS, pursuant to Section 3‑110 of the Lincoln County Zoning Resolution the Lincoln County Board of County Commissioners chose to review the Application, together with the staff report and the Decision of the Land Use Board; and

 

            WHEREAS, at a meeting of the County Board of County Commissioners held on April 7, 2008, the Lincoln County Board of County Commissioners held a public meeting at which it considered the Application, the staff report on such Application, the decision of the Land Use Board, the record of proceedings before the Land Use Board, and such other information as was brought before the Board of County Commissioners at such hearing; and

 

            NOW BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF LINCOLN COUNTY, COLORADO:

 

            I.            APPROVAL:

 

The application of Cedar Point Wind, LLC for a Use By Special Review and Development Permit is GRANTED, subject to the conditions set forth below.  The Use By Special Review and Development Permit shall remain valid for a period of 50 years, or until such time as Cedar Point, its transferees, successors and assigns no longer own an interest in the Property described in Exhibit A, whether by lease, easement, or otherwise, whichever occurs last.

 

            II.            FINDINGS OF FACT:

 

1.                  That proper notice has been provided as required by law for the public hearing before the Board.

 

2.                  That the information contained in the record of proceedings and presented to the Board at the public hearing is extensive and complete, and that all pertinent facts, matters and issues were submitted and considered by the Board.

 

3.                  That the Wind Energy Generation Facility, as described in the Application, is consistent with the minimum zoning requirements set forth in the Lincoln County Zoning Resolution.

 

4.                  That the Wind Energy Generation Facility is consistent with the goals and strategies set forth in Lincoln County's Comprehensive Plan.

 

5.                  That the Wind Energy Generation Facility will be compatible with the character of the surrounding neighborhood and will not have negative impacts on adjacent properties.  The Wind Energy Generation Facility has been designed to mitigate any potential noise, odor, vibration, glare and similar impacts associated with the proposed land use.

 

6.                  That the Wind Energy Generation Facility will not cause undue traffic, congestion, dangerous traffic conditions, or other vehicle-related impacts due to the implementation of project-wide Best Management Practices and effective traffic control measures during construction.

 

7.                  That the Wind Energy Generation Facility will not require a level of community services or facilities that is not available, and the Applicant will provide the necessary improvements to address any deficiencies to facilities and services that the use would cause.  All public roads, utilities, bridges and septic systems to be developed in connection with the Wind Energy Generation Facility will comply with County standards.

 

8.                  The operating characteristics of the Wind Energy Generation Facility shall not create a nuisance and the project has been designed to minimize impacts on neighboring properties with respect to noise, odor, vibrations, glare, and similar conditions.

 

9.                  That an adequate water supply is available to provide water to the Wind Energy Generation Facility either through a public water supply system or wells adequate in quality and quantity to serve the development and approved by the State Engineer.  The water supply will comply with all applicable requirements of the Colorado Water Quality Control Division and the State Engineer.

 

10.              That the Wind Energy Generation Facility will not cause significant deterioration of surface or groundwater resources.  The Wind Energy Generation Facility has been designed and will be constructed to:

 

a.                   Prevent any changes to patterns of water circulation, conditions of the substrate, extent and persistence of suspended particulates, and the clarity, odor, color or taste of water

 

b.                  Comply with applicable water quality standards

c.                   Control levels of point and nonpoint source pollution

 

d.                  Prevent any changes in seasonal flow rates and temperature for affected streams

 

e.                   Prevent changes in aquifer recharge rates, groundwater levels and aquifer capacity including seepage losses through aquifer boundaries and at aquifer-stream interfaces

 

f.                    Prevent changes in circulation patterns, seasonal water levels and temperature of lakes or reservoirs

 

11.              That the Wind Energy Generation Facility will not significantly degrade wetlands or other aquatic habitat and riparian areas.  The Wind Energy Generation Facility is designed to avoid such areas or to minimize disturbance in these areas.  Specifically, the Wind Energy Generation Facility will not:

 

a.                   Cause any significant changes to the structure and function of wetlands and to unique, rare, delicate or irreplaceable riparian areas, vegetation, forest or woodlands

 

b.                  Cause any significant changes to the filtering and nutrient uptake capacities of wetlands and riparian areas

 

c.                   Cause any significant changes to aerial extent of wetlands and evolution of wetland species to upland species

 

12.              That the Wind Energy Generation Facility will not cause significant deterioration of grasslands or farmland.

 

13.              That the Wind Energy Generation Facility will preserve the integrity of existing and natural drainage patterns.  Where required by County standards, a stormwater retention system shall be provided to retain stormwater runoff in excess of historic flows and shall be designed for a 100-year flood.

 

14.              That to the extent necessary, the Wind Energy Generation Facility will be served by an adequate wastewater treatment system that meets all applicable County, state and federal standards.

 

            III.            CONDITIONS:

 

1.                  This Project Approval does not limit or affect the private property rights of mineral owners to reasonably access and use the surface of the permit area for the purpose of exploring for, developing and/or producing oil, gas and other minerals in accordance with Colorado law.

 

2.                  All trucks delivering materials to the Wind Energy Generation Facility must use State highways as their primary access to the Cedar Point Wind Project to the greatest extent possible.

 

3.                  Trucks that use Lincoln County roads to deliver construction materials to the Wind Energy Generation Facility will use routes designated by the Lincoln County Road and Bridge Foreman. Legal load limits will be strictly observed.

 

4.                  Upon completion of the Wind Energy Generation facility all "improved county roads" will be returned to the roadway widths in existence prior to commencement of construction as designated by the Lincoln County Road and Bridge Foreman. All "improved county roads" that have been horizontally re-aligned will be returned to their original alignment unless the adjacent landowners and Lincoln County accept the re-alignment:  acceptance to be in writing.

 

5.                  Cedar Point and contractors agree to maintain any Lincoln County Road utilized by haul vehicles to deliver construction materials to the various work locations. This maintenance to include any dust abatement required.

 

6.                  Where Wind Energy Generation Facility traffic uses Lincoln County Bridges the owner or contractor, as applicable, will be held responsible for any damages done to the bridges as a result of such use.

 

7.                  All vehicles (excluding emergency vehicles) accessing the project must observe Lincoln County road speed limits.

 

8.                  As it is Lincoln County policy to not plow snow on County Roads during active storms, if the Wind Energy Generation Facility contractors want this snow removed it will be their responsibility.

 

9.                  All construction debris (including concrete truck clean out) and trash cannot be buried nor burned on site but must be disposed of at a properly permitted landfill on a regular basis.  Suitable containers/dumpsters shall be utilized to prevent the debris from becoming wind-blown.

 

BE IT THEREFORE RESOLVED, that a Use By Special Review and Development Permit is granted to Cedar Point Wind, LLC, to construct a Wind Energy Generation Facility in accordance with the terms of the Application, subject to the conditions set forth above.  The Lincoln County Board of County Commissioners retains continuing jurisdiction over the permit to address future issues concerning the site and to insure compliance with the conditions of the permit.  The applicant is responsible for complying with all of the forgoing conditions and all other county zoning or other land use regulations.  Noncompliance with any of the conditions may be cause for revocation of the permit.

The Development Agreement between Lincoln County and Cedar Point Wind, LLC was reviewed, and a couple of errors were found; one typographical and the other an incorrect address.  Since the attachments were also inadvertently forgotten, Mr. Burgess made a motion to approve the development agreement with Cedar Point Wind, LLC, as soon as the corrections were made and the attachments submitted.  Mr. Beedy seconded the motion which carried unanimously.

 

The final question was whether or not there was room for expansion of the project if the need ever arose, and Ms. Pittsford responded that there are forty-two miles of transmission line, which was the biggest obstacle in the project.  If the line were capable of handling more kilowatts of power, the land was definitely there for future expansion.  The comment was made that this project would need to be completed within two years, or negotiations would have to start all over again.

 

Once the others had gone, Mr. Morrison said that AES Wind Generation (formerly SeaWest Wind Power) intended to turn in a proposal on Excel’s RFP and were requesting a generic letter from the Board stating that wind energy projects were supported in Lincoln County.   Mr. Burgess made a motion to sign a letter supporting wind energy projects in Lincoln County, Mr. Beedy seconded the motion, and it carried unanimously.

 

The County Attorney had nothing to report, so Mr. Lyons called for new business.  Mr. Burgess commented that Travis Nall had fixed a hole in the courthouse roof and wondered if they should be concerned that the roof may eventually need replaced.  They all agreed it would be a tremendous expense.  Mr. Burgess also told the others that he would be viewing a demo of an M-series road grader.

 

Ms. Devers informed the Board that she had made a mistake with an employee’s retirement funds last year when he decided to cease making contributions and withdraw his money from the county’s retirement plan, resulting in his investment company receiving approximately $17,000.00 too much.  She called the investment company and spoke with Gary Hamsher numerous times, constantly being told that he would send the money back to the county, but she still has not received it.  Mr. Kimble asked if she would like for him to send Mr. Hamsher a letter, and Ms. Devers said she would need to get his address because all she had was a phone number, but she agreed it was time for further action.
